WHAT DOES "MEDIATION" MEAN?

According to The Law on Mediation, it is a voluntary and confidential out-of-court dispute resolution procedure in which a third-party mediator helps disputing parties reach an agreement.
Its subject may be civil, commercial, labor, family and administrative disputes related to consumer rights, and other disputes between individuals and/or legal entities, including when they are cross-border.
When using this procedure, our specialists carry out their activities in good faith, in compliance with the law, good morals, procedures and ethical rules for the behavior of the mediator, observing the following principles:
– voluntariness and equality;
– neutrality and impartiality;
– privacy.
The procedure starts at the initiative of the parties to the dispute, and each of them can make a proposal for its resolution through mediation.
A proposal to resolve the dispute by using this procedure can also be made by the court or other competent body before which the dispute is referred for resolution.
The agreement of the parties to resolve a possible future dispute between them can also be stipulated as a clause of a contract.
The mediation procedure is carried out by one or more mediators designated by the parties.
The parties to the dispute participate in the procedure in person or through a representative. Authorization is made in writing.
Lawyers and other specialists can also participate in the mediation procedure.
